Types of medical malpractice cases:

Medical malpractice cases often involve people who have suffered serious or life-long health consequences or lost a loved one from inadequate medical care.

There are many types of medical errors may result in medical malpractice cases. However, the basis of all medical malpractice claims is that the healthcare provider deviated from the standard of care. The standard of care is defined by what other health care providers with similar training and experience would do if faced with the same or similar situation.

Surgical Error

Medical malpractice cases for a surgical error can involve patients who suffered wrong site surgery, when a doctor operates on the wrong limb or part of the body. A surgical error can also be the result of improper or substandard surgical techniques, which may cause complications such as a failed procedure, bowel or organ perforation, or spinal cord injury. Sponges and instruments inadvertently left inside the surgical site are also a form of surgical error.

Misdiagnosis

Failure to diagnose, delayed diagnosis or misdiagnosis of serious health conditions are often, but not always, cause for medical malpractice cases. Misdiagnosis and other diagnosis errors can be the result of a physician’s failure to read medical tests, x-rays, scans or mammograms properly. Misdiagnosis can lead to improper or delayed treatment of conditions such as cancer or heart problems later resulting in heart attack and can have devastating consequences.

Medication Errors

Medication errors can occur when a medical professional gives a patient the wrong medication, wrong dosage or medication via the wrong delivery route, such as intravenously. Medication errors do not always happen in hospitals, but sometimes by illegible written prescription or error at the pharmacy. Medication interactions or allergic reactions may also be considered medication errors.

Anesthesia Error

An anesthesia error involves a mistake in the administration of general or spinal anesthesia during surgery. A general anesthesia error can cause damage to a patient’s brain or heart, while a spinal anesthesia error can result in spinal cord damage and even paralysis. An anesthesia error is usually the result of improper dosage, failure to monitor the patient properly, faulty monitoring equipment, failure to recognize complications or respond appropriately to them. A lack of anesthesia, causing the patient to experience the surgery in a state of awareness and pain, is also an anesthesia error.

Birth Injury

The most celebrated experience, the birth of a child, can turn devastating if the infant suffers a birth injury. It is heartbreaking for a parent to discover their baby is suffering from a birth injury such as Cerebral Palsy, Erb’s Palsy, bone fractures, brain injury or conditions caused by oxygen deprivation. A birth injury can be the result of a lack of pre-labor testing, improper monitoring during labor, surgical error, delay of C-section or the actions of medical personnel during the delivery.
